We recently represented a father of a child who had been prosecuted for not ensuring their child attended school .
regrettably our client was unable to ensure proper school attendance because of a breakdown of his relationship with the child’s mother. They were not living together and she would not allow him access to the child. In fact she had applied for orders against him and made false allegations against him to the police.
On our advice the father pleaded not guilty to the offence in the magistrates court. We wrote to the local authority about the background to this matter and happily the prosecution decided to withdraw the case against him before the trial took place. He therefore avoided the prospect of either a heavy fine, community order or prison.
